The full terms follow. They're binding, so they're worth the five minutes.
These Terms are a contract between you and Çınar Şan Kartal, of Esatpaşa Mah. Güzel Bahar Sok. No: 4A, Daire 17, 34704 Ataşehir/İstanbul, Türkiye (“we”, “us”). They cover your use of the Tells mobile application and everything in it, wherever in the world you are using it.
By installing or using the app you accept these Terms. If you don't accept them, delete the app — that's the whole opt-out, and there's nothing to cancel because there's no account and nothing to pay.
Our Privacy Policy forms part of these Terms.
Tells is rated 18+ and you may only use it if you are at least 18. If you are under 18, you may not use the app.
The app looks at one photograph of two people and describes what their bodies are doing in that frame: how close they're standing, which way they're turned, whether there's contact and whether it's returned, posture, expression. It turns that into a score and a write-up.
All of this happens on your device, using your phone's own vision capabilities. The app has no servers and needs no internet connection to work. Your photo is never sent anywhere — see the Privacy Policy.
The signals the app uses are drawn from published work on nonverbal behaviour. Applying them to a single still image is nonetheless inference, not measurement, and it is not a validated method for determining what anybody thinks or feels. The app tells you this on every result screen, and we mean it here too.
One thing we will not be ambiguous about. A high score is not permission, an invitation, or an indication that anyone wants anything from you. Consent is something a person gives you in words, freely, and can take back at any time. Nothing this app produces changes that, and using a result to justify pressuring, pursuing or touching someone is a serious misuse of it and a breach of these Terms.
Most photos you analyze have someone else in them. This section exists because of that.
Your photos never reach us, so this is not about what we might do with them. It is about what you may do with the app. Every time you analyze a photo, you confirm that:
You are solely responsible for the photos you use and for the consequences of using them.
The app is available in most countries, and the law on photographing people and using their image varies enormously between them — what is unremarkable in one place can require written consent in another. The rules that bind you are the ones where you are and where the photo was taken, and it is your job to know them.
You must not use Tells to:
You also must not reverse-engineer, decompile or tamper with the app, access it by automated means, resell or redistribute it or its output as a service, or attempt to extract the underlying models or logic.
If you breach this section your licence to use the app ends.
Tells is free. There are no in-app purchases, no subscription, and no paid tier.
We may introduce paid features in a future version. If we do, we'll say so clearly in the app before anything costs money, and any purchase would be handled by Apple under the App Store's terms — including its refund policy, which is Apple's and not ours.
Yours. Your photos are yours and stay yours. We claim nothing in them, and unlike most apps we don't ask you for a licence to them either — we never receive them, so there is nothing to license. The results the app produces for you are also yours, to keep, screenshot and share.
Ours. The app, its name, design, text, scoring approach and everything else in it belong to Çınar Şan Kartal and are protected by copyright and trade mark law. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own non-commercial use. Nothing more is granted.
The app can generate a card summarising a result. It contains a score, a label, a one-line summary and two bars — never the photograph.
What you do with that card afterwards is on you. Posting a result about an identifiable person, in a way that embarrasses or exposes them, may harm them and may breach the law where you live even though the picture isn't in it. Please think before you post one.
We'd like the app to work, but we don't promise it always will. We may change, suspend or discontinue it, or any feature of it, at any time. We may update these Terms; if we make a material change we'll bring it to your attention in the app before it takes effect, and continuing to use the app after that means you accept it.
You can end this agreement whenever you like by deleting the app. We may end it if you breach these Terms. Sections 10, 11, 12, 13 and 14 survive the end of it.
To the fullest extent the law allows, the app is provided “as is” and “as available”, without warranty of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
In particular, and without limiting the above, we do not warrant that any result is accurate, complete, reliable, or a correct account of anything. You have read section 3 and you accept results on that basis.
To the fullest extent the law allows, neither Çınar Şan Kartal nor anyone working with us will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill, opportunity or relationship, arising out of or connected with your use of the app — including any decision you or anyone else takes on the basis of a result.
Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to the greater of (a) the amount you have paid us for the app in the twelve months before the claim, which for a free app is nothing, and (b) 2.000 TRY.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law. If you are a consumer, your mandatory statutory rights under the consumer protection law of your country of residence are unaffected by these Terms.
You agree to indemnify and hold harmless Çınar Şan Kartal from any claim, demand, loss, liability or expense (including reasonable legal fees) brought by a third party and arising from your breach of these Terms or your misuse of the app — including a claim by a person appearing in a photo you analyzed or in a card you shared.
These provisions apply to your use of the app on Apple devices and are required by Apple.
These Terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of İstanbul Anadolu have jurisdiction over any dispute. That is simply where we are.
If you are a consumer, that choice takes nothing away from you. You keep every mandatory protection given to you by the law of the country you live in, and you keep any right you have to bring proceedings in your own local courts. Where anything in these Terms conflicts with a right you cannot lawfully be deprived of, that right wins and the conflicting words don't apply to you.
The app is offered from Türkiye and is made available through the App Store in the countries Apple distributes it to. We make no representation that it is appropriate or lawful to use in any particular place, and if you use it you are responsible for complying with the law where you are — including, as section 4 says, the law on using photographs of other people.
These Terms are written in English and the English text governs. Any translation is for convenience only, except where the law where you live requires otherwise.
If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing something isn't a waiver of it.
